Personal Injury Attorney

Uninsured motorist coverage, or UM, may cover losses caused by a driver who has no applicable insurance. Underinsured motorist coverage, or UIM, addresses a different situation: the other driver has liability insurance, but the relationship between that coverage and your UM/UIM limits may permit an additional claim. In New Mexico, UIM is not a promise to pay the full difference between your losses and the other driver’s payment.

To understand your coverage, read the documents that applied on the crash date. An insurance card or a current balance in an app cannot answer all the questions. You need to know who the policy covers, which limits apply, and whether the insurer relies on a coverage selection, rejection, or exclusion.

Start by separating three insurance questions

After a crash, several people may use the word “coverage” to mean different things. Ask which question the insurer is answering:

Does the other driver have liability insurance that applies? Their insurer may accept coverage, deny it, or ask for more information. A card alone does not resolve that question.

Are you an insured person under a UM/UIM policy? The answer requires the policy’s definitions and your circumstances. The car you occupied, your relationship to the policyholder, and other household policies may matter.

How much coverage could apply? The declarations page is a starting point, but limits, offsets, and the treatment of more than one vehicle or policy can affect the analysis.

Keep the answers separate. An insurer can acknowledge that a policy exists while still disputing whether it covers you or what it owes. Ask the adjuster to identify the issue in writing.

Read the policy as a set of documents

Ask for a complete copy of the policy in effect on the date of the collision, including its declarations and endorsements. An endorsement changes or adds policy terms. If you renewed or changed vehicles near the crash date, ask which version applied.

Declarations page

Find the policy period, named insureds, vehicles, and UM/UIM limits. Copy the exact wording of each limit. A limit per person and a limit per accident serve different purposes.

UM/UIM endorsement

Find the definition of an insured person and the covered losses. Mark the provisions the insurer cites in a coverage letter, including any offset or exclusion.

Coverage offers and selections

Compare the choices offered with the coverage selected. Keep the premium information, dated selection forms, and any rejection the insurer says applies.

Policy change documents

Keep notices that added or removed a vehicle, changed a limit, or renewed the policy. Compare their effective dates with the collision date.

Use copies for highlighting and keep the originals intact. If a page is missing or unreadable, request a replacement and record the date of that request. You can ask a lawyer to review an incomplete file while you wait for the missing pages.

Why “the other driver did not have enough insurance” is only the beginning

New Mexico’s UIM rules include an offset framework. The Office of Superintendent of Insurance’s Bulletin 2021-024 requires insurers to disclose that the total payment is limited by the greater of the applicable UM/UIM limit or the other party’s liability limit, subject to other policy provisions. It also requires an exclusion addressing reimbursement that equals or exceeds the policy’s UM/UIM coverage.

Simplified hypothetical: Assume one available UIM limit of $50,000, a $25,000 payment from the responsible driver’s liability insurer, covered damages above $50,000, and an applicable $25,000 offset. Under those assumptions, the UIM limit remaining after that offset would be $25,000. You would not add a full $50,000 UIM payment to the $25,000 liability payment.

This example illustrates subtraction, not a claim valuation or an El Gringo Law result. A lawyer must examine the policies, available coverages, disclosures, and payments before applying an offset to a real case. If an adjuster says no UIM benefits remain, ask for the calculation and the policy terms supporting it.

New Mexico requires a per-vehicle offer

For a policy covering several vehicles, the offer of UM/UIM coverage deserves its own review. Following Kileen v. Didio, the Office of Superintendent of Insurance issued Bulletin 2025-013, requiring insurers to offer UM/UIM coverage on a per-vehicle cost basis. Consumers must have the option to purchase coverage for the vehicles they choose, instead of facing an all-or-nothing offer across the policy.

Ask for the offer and pricing records associated with the policy and any relevant change. A declarations page showing no UM/UIM does not, by itself, explain how the insurer offered coverage or how the policyholder rejected it. A lawyer can assess which requirements apply to the dates and documents in your file.

A per-vehicle offer and “stacking” are separate questions. Stacking concerns whether a person can combine applicable UM/UIM limits. Do not multiply the number of cars by a listed limit and assume that sum is available. Bring the policy documents for each potentially relevant vehicle or household policy so a lawyer can examine who qualifies for coverage and how the limits interact.

If the driver left the scene

A hit-and-run can raise UM questions even when you do not know the driver’s name. OSI’s consumer explanation of uninsured motorist coverage includes hit-and-run drivers. The policy and facts still need review; an unknown driver does not establish that the insurer owes a particular payment.

Tell the insurer that the driver remains unidentified. Keep the report or incident number and distinguish what you observed from what a witness told you. Ask which policy provisions and information the adjuster needs to evaluate the unknown-driver claim. Preserve an original photograph or video you already have, including the original file, even if it shows only part of the vehicle.

For help locating the official record, use our New Mexico crash report guide. A police investigation and an insurance coverage review can require different information.

Turn a coverage letter into specific questions

Read the insurer’s letter alongside the cited policy pages. Make a short note with the insurer’s position, the provision it relies on, and the fact you need to check. This helps you ask a question the adjuster can answer.

If the insurer says you rejected UM/UIM, request the offer, premium options, and rejection records it relies on.

If it says you are not an insured person, ask which definition applies and what facts it used.

If it applies an offset, request the limits and payments used in the calculation.

If it requests more information, ask which coverage or claim issue that information addresses and note the response date.

Before accepting a liability settlement or signing a release, ask a lawyer whether the proposed terms could affect a potential UM/UIM claim. Provide the complete release and any letter that came with it. A verbal description of the offer can omit terms that need attention.

If you disagree with the insurer

Begin with a written request for the reason, the relevant policy provision, and any missing information. Keep the response with your policy documents. You can then choose whether to seek a legal review, raise an insurance complaint, or both.

The New Mexico OSI Consumer Assistance Bureau accepts complaints about policy issuance or cancellation and claim processing. The bureau says it cannot determine damages, make settlement decisions for you, provide legal advice, or act as your representative. A complaint therefore serves a different purpose from retaining a lawyer to evaluate your rights. Ask a lawyer to identify any filing or notice dates that require attention while the insurance discussion continues.

Bring these questions to a coverage review

You can make a first conversation more useful by identifying the point you cannot resolve: whether UM/UIM exists, whether you qualify as an insured person, or how the insurer calculated its limit. Bring the policy packet, the crash date, and the insurer’s written explanation. Note any policy you have requested but have not received.

El Gringo Law can review a New Mexico crash and the coverage questions it raises. Call (505) 207-5000 or request a case review.
