This page provides general information, not legal or insurance advice.

Short answer: New Mexico requires minimum liability coverage commonly called 25/50/10: $25,000 for bodily injury or death of one person, $50,000 for bodily injury or death of two or more people in one accident, and $10,000 for property damage in one accident. Those amounts answer an important compliance question, but they do not answer every coverage question after a crash.

25/50/10 in plain English

The New Mexico Motor Vehicle Division lists the state’s minimum auto-liability amounts. The first number, 25, refers to $25,000 for bodily injury or death of one person in an accident. The second, 50, refers to $50,000 for bodily injury or death of two or more people in a single accident. The final number, 10, refers to $10,000 for property damage in one accident.

These are liability minimums. They are not an estimate of the value of a vehicle, the cost of medical care, or the amount an insurer will pay in any given situation. A policy has its own declarations page, definitions, exclusions, endorsements, and limits. A serious question about coverage belongs with the policy records rather than an assumption based on the shorthand alone.

25 is the listed per-person bodily-injury or death minimum.

50 is the listed total bodily-injury or death minimum for two or more people in one accident.

10 is the listed property-damage minimum for one accident.

The fact that a vehicle carries the legal minimum does not independently determine fault, coverage, or the result of a claim. It is a starting point for understanding a policy, not a conclusion about an individual crash.

Keep the MVD verification issue separate from a crash claim

The MVD’s insurance information page explains that insurers report coverage electronically to the New Mexico Insurance Identification Database. The page also explains what a driver can do after a Notice of Noncompliance, including contacting the insurer to make sure the vehicle information is reported correctly.

That administrative process is different from deciding how a collision happened or whether a policy applies to a specific loss. If a notice arrives even though a policy is active, keep the notice, the current insurance card, the policy number, and the vehicle identification number together. Ask the insurer to check the information it reported to the database rather than treating a database issue as proof of what coverage a policy provides.

The MVD lists common proof-of-insurance records for registration, including a current insurance card, a copy of the policy, or a letter from the insurance company. Its page also addresses out-of-state insurance and non-use affidavits for people whose vehicles remain registered in New Mexico. Use the MVD’s current instructions for those administrative questions.

UM/UIM needs a policy-specific review

Uninsured motorist and underinsured motorist coverage, often shortened to UM/UIM, is not the same thing as the basic 25/50/10 liability minimum. The New Mexico Office of Superintendent of Insurance Bulletin 2025-013 addresses UM/UIM disclosure and exclusion forms and explains the requirement for an offer on a per-vehicle cost basis after a New Mexico Supreme Court decision.

That public bulletin is useful context, but it cannot tell a reader whether a particular policy has UM/UIM coverage, how an endorsement is written, or whether a coverage question applies after a particular crash. Those questions call for the actual declarations page, relevant policy documents, and the insurance correspondence already received.

When reviewing a policy, distinguish the other driver’s liability limits from your own optional coverages. Do not assume that a word such as “underinsured,” a coverage label in an app, or an oral explanation settles the issue. The written policy and the insurer’s response matter.

Use the documents, not a rule of thumb: Liability limits, medical-payments coverage, UM/UIM, deductibles, exclusions, and endorsements can appear in different parts of a policy. Keep the declaration page and each insurer letter with the rest of your crash records. A general guide cannot determine what a particular policy covers.

What to find on a declarations page

A declarations page is often the clearest starting point when someone needs to understand the coverage listed for a vehicle. It usually identifies the policy period, named insured, vehicles, and selected coverages. The layout varies by insurer, so read it with the complete policy and any endorsements instead of relying on one field.

The policy number, effective dates, and listed vehicle identification number.

The liability limits shown for bodily injury and property damage.

Any UM/UIM, medical-payments, collision, or comprehensive entries shown on the page.

Deductibles, exclusions, endorsements, and the contact information on insurer correspondence.

Any notice, reservation-of-rights letter, coverage decision, or request for additional information.

Make a copy before marking up anything. Keep the original files and a dated record of calls or messages. That simple organization helps avoid mixing policy facts with a memory of what was said on the phone.

After a crash, organize the record before making coverage assumptions

For people trying to understand insurance after a crash, a useful first set of records can include the incident number or report, photos and video in their original form, the declarations page, every insurance letter, repair information, medical records already received, and a dated timeline. Preserve the original version of each item when possible.

Do not alter records or try to obtain private accounts, phones, or files that do not belong to you. If a release, settlement document, or coverage letter raises questions, a private legal review can help identify what the document says and what records may be relevant before a decision is made.

For a separate explanation of evidence and fault questions, see how fault can be evaluated after a New Mexico car accident. This page remains focused on the state insurance minimums and the policy records that explain a particular coverage question.

If the other driver has only minimum limits

Separate three questions: what your injuries have cost, who is responsible, and what insurance or other recovery sources are available. A stated policy limit answers none of those questions by itself. Ask for the coverage position in writing and keep it with the offer, declarations information, and any proposed release.

When several people are injured in the same crash, a per-accident bodily-injury limit may have to address multiple claims. Do not assume the full per-person amount is reserved for you or that an insurer’s offer proves the total amount available. The property-damage limit is a separate coverage category; it is not an extra bodily-injury allowance.

If you have your own UM/UIM coverage, ask how it interacts with the other driver’s policy before signing a release. The policy wording, coverage selections, and applicable law matter. Our New Mexico UM/UIM guide explains the documents to gather for that review.

Questions to take into a coverage review

Which insurer is writing to me: the other driver’s insurer, my insurer, or both?

Is the stated limit for one person, all injured people, or property damage?

Does the offer address only the vehicle, only injuries, or more than one part of the claim?

Which policy period and vehicle are being considered?

What rights or claims would the proposed release end?

You do not need to answer these questions alone before calling.
