What a Hospital Parking Lot Negligent Security Claim Is<\/h2>\n

A negligent security claim says a property owner or manager failed to protect people from a crime that could have been expected. Hospitals, medical centers, and their parking lots and garages can be held to this standard.<\/p>\n

New Mexico law says a landowner must use ordinary care to keep the premises safe for visitors (UJI 13-1309 NMRA<\/a>). That duty also covers harm from a third party’s foreseeable conduct, including criminal conduct (UJI 13-1320 NMRA<\/a>). In plain words, the owner must act reasonably against crimes it should have expected.<\/p>\n

The health system that runs the campus may be a party if it owns or controls the lot or garage. This claim is about the property’s security. It is not only about proving who the attacker is, although the attacker’s conduct is part of the story.<\/p>\n

What the Claim Covers and Who Can Bring It<\/h2>\n
