It changes how a person lives, works, or cares for themselves. This page explains catastrophic injuries Taos residents may face after a crash, a fall, or an assault, and what to consider next.

What Does “Catastrophic Injury” Mean?

A catastrophic injury is a serious injury that lasts, may be permanent, and changes daily life. The term describes harm caused by an event, such as a crash, a fall, or an assault. It does not describe an illness.

Doctors describe injuries by their medical details. They note which nerves or organs were hurt and how long recovery may take. A claim looks at more than the diagnosis. It asks how the injury affects work, family life, and everyday tasks, and what caused it.

The label matters because it shapes how a claim is documented and valued. Clear records of medical care and daily limits help show that effect. For the medical background on one common injury, the NINDS spinal cord injury overview explains how the spinal cord works.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common Catastrophic Injuries Seen After Accidents

Catastrophic injuries often include spinal cord injuries, traumatic brain injuries, amputations, severe burns, and serious fractures or organ damage. Each one brings its own medical and daily challenges.

Spinal cord injuries. The spinal cord sits inside three layers of protective tissue. Cerebrospinal fluid cushions it. Doctors describe spinal injuries by level. Cervical nerves, C1 to C7, carry signals to the neck, shoulders, arms, hands, and diaphragm. An injury between C1 and C4 can affect breathing, because those nerves drive the diaphragm. Depending on the level, paralysis of the arms or legs can follow.

Traumatic brain injuries. Brain injuries can be hard to judge at first. Our page on brain injury claims covers this in more detail.

Amputations. Losing a limb often means fitting a prosthetic, adjusting it over time, and completing physical therapy. This care may continue for a long time.

Severe burns. Burn injuries can need repeated treatment and reconstructive surgery. Healing often takes a long time.

Fractures and organ injuries. Multiple broken bones, internal organ damage, and long hospital stays can also make an injury catastrophic.

How Serious Injuries Happen on Taos Roads and Properties

Catastrophic injuries in Taos often start with a crash on a rural road, a fall on someone else’s property, or an assault where protection was lacking.

Rural stretches with changing speeds and narrow shoulders leave less room for error when a driver reacts late.

Winter adds risk. Snow and ice on mountain grades can change how a crash happens and how hard vehicles hit. Visitors add risk too. Unfamiliar drivers and heavy trucks share the same roads, which can raise the chance of a serious crash.

Property injuries follow a clear standard. New Mexico’s UJI 13-1318 slip and fall instruction says an owner or occupant must use ordinary care to keep premises safe for visitors. That duty applies whether or not a danger is obvious.

Some assaults happen because a property lacked reasonable security. Cases involving negligent security or sexual assault are sensitive. Survivors can talk with us privately, at their own pace.

Who May Be Responsible for a Catastrophic Injury?

Responsibility can fall on a driver, a trucking company, or a property owner. The answer depends on what caused the injury.

A negligence claim usually requires a duty, a breach of that duty, and a cause of the harm. Herrera v. Quality Pontiac explains that a proximate cause produces the injury in a natural and continuous sequence. It need not be the only cause.

Impaired driving is also unlawful. Under NMSA § 66-8-102, it is unlawful for a person who is under the influence of intoxicating liquor to drive a vehicle within this state.

Under 49 CFR § 395.3, a driver of a property-carrying commercial motor vehicle may not drive without first taking 10 consecutive hours off duty, may not drive after a period of 14 consecutive hours after coming on duty following 10 consecutive hours off duty, and may drive a total of 11 hours during that period. Driver logs can matter in a truck case. A claim may also reach a company that entrusted a vehicle to a driver. In DeMatteo v. Simon, the claimant had to show the owner knew or should have known the driver was incompetent, and that incompetence caused the injury.

An injured person’s share of fault reduces damages but does not bar recovery. Under NMSA § 41-3A-1, in a cause of action to which the doctrine of comparative fault applies, the doctrine imposing joint and several liability on two or more wrongdoers is abolished except as otherwise provided, and the liability of such defendants is several.

Have questions about what happened?

Ask our team directly.
