Under § 41-2-1, a person or corporation whose wrongful act, neglect or default causes a death, where the act would, if death had not ensued, have entitled the injured party to maintain an action and recover damages, is liable to an action for damages, notwithstanding the death of the person injured. A person may survive for days or weeks in a hospital before dying of infection, complications, or treatment. New Mexico law can still apply when those burns trace back to someone else’s wrongful act, neglect, or default.

What a Fatal Burn Injury Wrongful Death Claim Is

A fatal burn injury wrongful death claim is a civil lawsuit for damages when a burn injury leads to a death caused by someone else. New Mexico law says that when one person’s wrongful act, neglect or default causes a death, and that act would, if death had not ensued, have entitled the injured party to maintain an action and recover damages, the party who would have been liable can be sued for damages. NMSA 41-2-1 Liability continues notwithstanding the death of the person injured.

Burn cases follow a chain. A fire or burn starts the harm. Surgery, infection, or organ failure may follow, and then death. Courts ask whether the wrongful act was a proximate cause. That means a cause that, in a natural and continuous sequence unbroken by an independent intervening cause, produces the injury. It need not be the only cause. Herrera v.
