In New Mexico, the case is filed by the deceased person’s personal representative, and it must be brought within three years of the date of death (NMSA<\/a> 1978, \u00a7 41-2-2<\/a> — three years from the date of death). A Wrongful Death Claim After a Fatal Car Crash in New Mexico Is Its Own Lawsuit<\/h2>\n

A wrongful death claim is a lawsuit for a death caused by someone else’s wrongful act, neglect, or default. Under NMSA \u00a7 41-2-1<\/a>, the person who, or the corporation which, would have been liable if death had not ensued, shall be liable to an action for damages, notwithstanding the death of the person injured.<\/p>\n

As NMSA \u00a7 41-2-3<\/a> requires, the action shall be brought by and in the name of the personal representative of the deceased person. The money is not liable for the deceased person’s debts, provided the decedent has left a spouse, child, father, mother, brother, sister or child or children of the deceased child. It goes to the survivors the statute names, such as a surviving spouse, children and grandchildren, parents, or siblings, in the order the law sets.<\/p>\n

What a Wrongful Death Claim Can Recover in New Mexico<\/h2>\n

A New Mexico jury can award compensatory and exemplary damages that it considers fair and just. Under NMSA \u00a7 41-2-3<\/a>, the jury may give such damages, compensatory and exemplary, as it deems fair and just, taking into consideration the pecuniary injury resulting from the death to the surviving party entitled to the judgment. It also weighs the mitigating or aggravating circumstances of the wrongful act.<\/p>\n

Exemplary damages, sometimes called punitive damages, can reflect how serious the conduct was. They are one part of what the jury may consider, not a separate claim you file on your own.<\/p>\n

Close family members may also have a loss of consortium claim. Under UJI 13-1810A NMRA<\/a>, the claimant must show a mutually dependent relationship with the person who died. That means they relied on each other and could not enjoy life in the same way after the death.<\/p>\n

Who May Be Responsible for a Fatal Crash<\/h2>\n

Any driver, company, or other party whose negligence caused the death may be responsible. A proximate cause need not be the only cause.<\/p>\n

Common breaches in crashes include speeding, distracted or impaired driving, failing to yield, and running red lights. New Mexico follows pure comparative negligence (shared fault). A plaintiff is not totally barred because of their own negligence (Scott v. Rizzo<\/a>). Under UJI 13-2218 NMRA, where comparative negligence is an issue in the lawsuit, the court is submitting the case on a general verdict without special interrogatories, and there is no apportionment of negligence among defendants or non-parties, the jury reduces damages by the plaintiff’s percentage of fault.<\/p>\n

Can you sue a truck driver?<\/strong> Yes. A commercial driver can be a defendant when that driver’s negligence caused the death. Trucking companies and others may also be involved. Federal hours-of-service rules apply to all motor carriers and drivers, except as provided in paragraphs (b) through (x) of this section, under 49 CFR \u00a7 395.1<\/a>.<\/p>\n

Under NMSA \u00a7 41-3A-1<\/a>, in any cause of action to which the doctrine of comparative fault applies, the doctrine imposing joint and several liability is abolished except as otherwise provided, and the liability of such defendants is several. Some exceptions apply.<\/p>\n

Uninsured motorist coverage under NMSA \u00a7 66-5-301<\/a> shall include underinsured motorist coverage for persons protected by an insured’s policy. Whether it applies to your family turns on the policy itself.<\/p>\n
