Who may be responsible for a dangerous condition depends on the facts of each case, including who controlled the space. This page explains who can be sued after an assault on property, what the injured person generally must prove, and what the process often looks like.

What a Negligent Security Lawsuit Is and Who It Is For

A negligent security claim says a property owner failed to protect people from a crime committed by someone else. The focus is the failure to protect, not only the attacker’s act.

New Mexico law says an owner or occupant owes a visitor a duty to use ordinary care to keep the premises safe, as stated in UJI 13-1309 instruction. That duty reaches harm from the foreseeable conduct of others, including criminal conduct, per the UJI 13-1320 committee commentary.

Injured guests, customers, and tenants may bring these claims.

Common settings include apartment complexes, parking garages, stores, hotels, bars, and office buildings. Cases in Albuquerque, Bernalillo County, and Sandoval County, including Rio Rancho, turn on the facts. A key question is what the owner knew or should have known about the risk.

If someone you love was hurt in an assault on someone else's property, our team can talk it through with you in a free, confidential, no-obligation consultation. Other parties may share responsibility, depending on who ran the space.

Who may be responsible for conditions such as common areas, locks, lighting, gates, and known crime problems depends on the facts of each case. A security company may answer for its own hiring, training, and supervision. New Mexico recognizes negligent hiring, retention, and supervision when the defendant was the employer, knew or should have known that hiring, retaining, or supervising the employee would create an unreasonable risk of injury to a group or class that includes the injured person, failed to use ordinary care, and that negligence was a cause of the injury, per UJI 13-1647 instruction. The jury instruction for negligent hiring, supervising, or retaining an employee asks whether the employer knew or should have known of the unreasonable risk, per UJI 13-1647 NMRA.

A tenant or business operator that controls the space, such as a bar in a leased building, may also be named. Who may be held responsible for an assault depends on the facts of each case. That is a separate claim from negligent security.

When more than one party is at fault, New Mexico generally applies several liability. Section 41-3A-1 of the New Mexico Statutes provides that, in any cause of action to which the doctrine of comparative fault applies, joint and several liability is abolished except as otherwise provided, and the liability of such defendants is several. The section then names situations where joint and several liability still applies. These include any person who acted with the intention of inflicting injury or damage, and persons whose relationship to each other would make one vicariously liable for the acts of the other, but only to the portion of the total liability attributed to them.

What You Must Prove: The Four Elements of Negligence

A negligence claim generally requires proof of a duty, a breach of that duty, causation, and damages.

Duty: The defendant owed the injured person a duty of ordinary care as a visitor on the property.

Breach: The defendant failed to use reasonable security. Examples include poor lighting, broken locks, missing patrols, or open access points.

Causation: The security failure must be reasonably connected as a significant link to the injury, per the UJI 13-305 causation instruction. It need not be the only explanation.

New Mexico applies the doctrine of comparative fault.

Earlier similar crimes, complaints, and warnings can show what the owner knew or should have known.

Evidence That Often Decides These Cases

Police reports, security footage, and security records often carry the most weight. Some of this evidence can be lost quickly, so early action matters.

Crime history: The FBI Crime Data Explorer publishes agency-level reported crime data for New Mexico jurisdictions.

Footage: Video is often overwritten.

Contracts and logs: Security contracts, staffing schedules, patrol logs, and training records.

Repair requests: Maintenance tickets for broken lights, gates, locks, or fencing.

Complaints: Prior tenant or customer complaints, insurance claims, and written safety recommendations.

Medical records: These connect the injuries to the assault.

What a Claim Can Include

A claim can seek money for medical costs, lost income, and pain and other harm tied to the injury. The full picture depends on the injuries and the proof in each case.

Medical costs: Emergency care, surgery, rehabilitation, counseling, and future treatment.

Lost income: Lost wages and reduced ability to earn in the future.

Non-economic harm: Pain, suffering, and other losses tied to the injury.

Emotional distress: Whether it can be recovered turns on the facts of the injury and event.

Wrongful death: Section 41-2-1 of the New Mexico Statutes provides that whenever a person’s death is caused by the wrongful act, neglect or default of another, and that act, neglect or default would have entitled the injured party to maintain an action and recover damages if death had not ensued, the person or corporation that would have been liable is liable to an action for damages, notwithstanding the death of the person injured. We review what happened, who owned and controlled the property, and any documents you have.

Preservation: Early on, a written request can ask owners, managers, and security companies to keep footage, logs, and contracts.

Investigation: We review police records, prior incidents, and medical treatment.

Insurance: Insurers may ask for recorded statements or early medical releases.
