New Mexico’s UJI 13-1318 slip-and-fall instruction<\/a> says an owner or occupant must use ordinary care to keep the premises safe for a visitor. Negligent security cases look at which safety steps were reasonable under the facts.<\/p>\n

How Are Spinal Cord Injuries Treated, and How Does Recovery Go?<\/h2>\n

Treatment and recovery depend on the injury level, whether it is complete or incomplete, and the person’s overall health. The NINDS spinal cord injury overview<\/a> covers treatment and prognosis, and recovery varies from person to person.<\/p>\n

The level matters. Cervical nerves (C1 to C7) signal the neck, shoulders, arms, hands and diaphragm. An injury between C1 and C4 can stop breathing, because those nerves help move the diaphragm. Thoracic nerves (T1 to T12) reach the chest and many organs. Lumbar nerves (L1 to L5) and sacral nerves (S1 to S5) reach the lower abdomen, hips, legs and feet.<\/p>\n

What Does New Mexico Law Say About Deadlines and Fault?<\/h2>\n

New Mexico sets a three-year period for injury claims. Under Section 37-1-8 of the New Mexico Statutes<\/a>, an action for an injury to the person or reputation of any person must be brought within three years.<\/p>\n

New Mexico uses pure comparative negligence. An injured person is no longer totally barred from recovery because of their own negligence, as Scott v. Rizzo<\/a> held. Under UJI 13-2218 NMRA<\/a>, total damages are reduced by the injured person’s percentage of fault.<\/p>\n

In causes of action where several liability applies, Section 41-3A-1 of the New Mexico Statutes<\/a> provides that a defendant who establishes that the fault of another is a proximate cause of the plaintiff’s injury is liable only for the portion of the total dollar amount awarded as damages that equals the ratio of that defendant’s fault to the total fault attributed to all persons, including plaintiffs, defendants and persons not party to the action.<\/p>\n

A negligence claim generally requires a duty owed to the injured person, a breach of that duty, and a breach that was a proximate cause of the harm. The Herrera v. Quality Pontiac decision<\/a> states that elements. Claims often include medical costs, lost income, and pain and suffering.<\/p>\n
