It can affect movement, feeling and other body functions. The NINDS overview of spinal cord injury notes that three layers of tissue protect the cord, and cerebrospinal fluid cushions it against shock.

Symptoms do not always appear at once. Some show up right away, while others develop over days. That is why prompt medical evaluation matters. Your treating doctors decide diagnosis and treatment, and only they can explain what your injury means for your care.

For a Rio Rancho household, one injury can shift everything. A parent, spouse or adult child may suddenly manage appointments, time away from work and growing bills. Those practical changes are often the first things a claim must address.

How Do Spinal Cord Injuries Happen in Crashes Around Rio Rancho?

Spinal cord injuries in crashes often come from high-force impacts. Rollovers, head-on collisions and T-bone crashes can cause them, as can pedestrian and motorcycle impacts. High-speed crashes on busy routes such as NM 528 and the I-25 corridor carry that risk.

Trucking crashes add weight to the problem. A loaded commercial truck carries far more mass than a passenger car. For more on these cases, see our trucking accident page.

Falls on property can cause spinal injuries too. A broken stair, an icy walkway or a failed railing can do it.

Inadequate security can also lead to serious harm.

The cause of the injury shapes who may be responsible and what proof you need. Car crash cases are covered on our car accident page.

Complete vs. Incomplete Injuries and Why Records Matter

The medical record links the crash or fall to the injury, so it is central to any claim.

Where the injury sits on the spine matters. Cervical nerves, C1 to C7, carry signals to the neck, shoulders, arms, hands and the diaphragm, the muscle that moves the lungs. According to NINDS, an injury between C1 and C4 can stop breathing.

Doctors also describe injuries as complete or incomplete, and that label shapes the care plan. Only your medical team can tell you which description fits your injury.

Keep these records organized:

Emergency transport reports

Imaging results

Surgery and rehabilitation notes

Provider statements about future care needs

Copies of bills and pay stubs

A dated log of symptoms, limits and daily help you need

Treatment decisions belong to your medical team. The firm’s role is to organize the legal side of the record, so the proof stays clear and easy to follow.

Have questions about what happened?

Ask our team directly. Quality Pontiac explains. A proximate cause produces the injury in a natural and continuous sequence. It need not be the only cause.

Possible parties include an at-fault driver, a trucking company or driver, a property owner or manager, and a security provider in a negligent security case.

Section 41-3A-1 of the New Mexico Statutes provides that, where several liability applies, any defendant who shows that the fault of another is a proximate cause of the plaintiff’s injury is liable only for the share of the total dollar amount awarded to the plaintiff as damages that equals the ratio of that defendant’s fault to the total fault attributed to all persons, including plaintiffs, defendants and persons not party to the action. The statute lists exceptions, so each case needs review.

New Mexico adopted comparative negligence in Scott v. Rizzo. The UJI 13-2219 instruction shows the math: each defendant’s percentage is multiplied by the plaintiff’s total damages.

If the injury leads to death, a wrongful death claim has its own rules.

How Long Do You Have to File a Claim in New Mexico?

Section 37-1-8 of the New Mexico Statutes states that actions for an injury to the person or reputation of any person must be brought within three years. That is the general window for many personal injury claims.

Claims against a government entity or public employee move faster. Section 41-4-15 of the New Mexico Statutes provides that tort actions against a governmental entity or a public employee are forever barred unless commenced within two years after the date of the occurrence resulting in loss, injury or death, except that a minor under the full age of seven years has until his ninth birthday in which to file.

Notice comes first in those cases. Section 41-4-16 of the New Mexico Statutes requires every person who claims damages from the state or any local public body under the Tort Claims Act to present a written notice stating the time, place and circumstances of the loss or injury within ninety days after the occurrence, unless the governmental entity had actual notice of it; the ninety days do not count up to ninety days during which the injured person is incapacitated by the injury from giving notice. For a wrongful death claim against a public body, notice may be presented within six months after the injury that caused the death, by or on behalf of the personal representative of the deceased person, any person claiming benefits of the proceeds of a wrongful death action, or the consular officer of a foreign country of which the deceased was a citizen.

Under NMSA 1978, § 41-2-2, every wrongful death action must be brought within three years after the cause of action accrues, and the cause of action accrues as of the date of death (NMSA 1978, § 41-2-2 — three years from the date of death). That claim accrues on the date of death.

Early action helps protect proof. Video, vehicle data and witness names can fade over time.
