Trucking accidents Farmington residents face often involve more than two drivers. Federal rules, New Mexico rules, and fast-moving records all play a part. This guide explains those pieces in plain terms, so you can see what matters early.

Why a Farmington Truck Crash Involves More Than Two Drivers

A crash with a tractor-trailer often involves more people than the two drivers at the scene. The truck driver is the first person most people think of. The motor carrier is the company that employs or contracts that driver. Sometimes a cargo shipper, a loader, or a maintenance provider also plays a role.

The driver of the other vehicle matters too. A vehicle owner or contractor may also be part of the picture, depending on what happened. Each party has its own duties and its own records. Which party is responsible depends on the facts of your crash, so early questions help sort that out.

El Gringo Law handles trucking accident claims in New Mexico, including claims for people hurt in Farmington and San Juan County. The common ones are rear-end impacts, unsafe lane changes, jackknifes, and rollovers on curves. Trucks need much more room to stop than cars do. A truck that follows too closely can hit traffic that slows ahead.

New Mexico law says no driver may follow another vehicle more closely than is reasonable and prudent. That depends on speed, traffic, and road conditions (NMSA 66-7-318). Under New Mexico’s Section 66-7-318, the driver of any motor truck or motor vehicle drawing another vehicle, when traveling upon a roadway outside of a business or residence district, shall not follow another motor truck or motor vehicle drawing another vehicle within three hundred feet, though this does not prevent that driver from overtaking and passing any like vehicle or other vehicle.

A stopped or disabled truck in a travel lane creates a second risk. Drivers coming up behind may not see it in time, and secondary crashes can follow. Traffic backs up fast on the main routes near Farmington, including US-64 and US-550, which carry commercial traffic. If you drive these roads every day, expect large trucks around you.

Who May Be Responsible After a Semi-Truck Collision

Responsibility can reach the driver, the motor carrier, and sometimes others. It depends on what caused the crash. A driver’s own conduct, such as speeding, distraction, following too closely, or driving past allowed hours, can be part of a claim.

The motor carrier may face claims about how it hired, trained, supervised, or dispatched the driver. It may also face claims about how it maintained the truck. New Mexico recognizes negligent hiring, retention, and supervision. The plaintiff must show the employer knew or should have known the employee posed an unreasonable risk. The plaintiff must also show the employer failed to use ordinary care, and that this failure caused the injury (UJI 13-1647 NMRA).

Cargo loading or securing problems can involve a shipper or loader. Each party’s role turns on the facts.

Evidence That Can Disappear After a Truck Crash

The most useful truck crash evidence is often electronic, and the trucking company usually holds it. Federal rules require drivers to record their duty status, generally with an electronic logging device (ELD) (49 CFR 395.8). Those logs show when a driver was driving, resting, or on duty.

Driver qualification files also matter. Except for certain records that may be removed three years after execution, the motor carrier must keep the driver qualification file for as long as the driver is employed by that carrier and for three years thereafter (49 CFR 391.51).

If an alcohol test is not given within two hours, the employer must record why. After eight hours, it must stop trying to give the alcohol test. Drug test attempts end after 32 hours (49 CFR 382.303). Those windows explain why speed matters.

Other evidence includes dash camera footage, maintenance and inspection records, dispatch messages, cargo papers, and photos of the scene and vehicles. Some records are kept only for set periods. Acting early, and asking in writing that evidence be kept, can help protect it.

Have questions about what happened?

Ask our team directly. The first conversation is free, confidential, and there is no obligation to continue.

Talk to our team

Talk to our team

Serious Injuries That Call for a Careful Review

Truck crashes can cause catastrophic injuries, spinal cord injuries, amputations, burn injuries, and wrongful death. Each of these often brings long medical care, rehabilitation, equipment needs, and changes at work or at home. These needs take time to document. Keep copies of every bill, report, and treatment plan.

Deadlines can apply to injury and wrongful death claims, and exceptions may change them, so an early review helps.

Family members may have claims of their own in some cases. Daily life can also change in ways that are hard to put into words. A written journal of pain, sleep, and limits on work or family tasks can help show the full picture. Every case is different. Past results do not predict what happens in yours.

Crash Reports, Traffic Records, and Getting the Facts Straight

The investigating agency’s crash report is an early record that can shape a truck crash claim. It describes the vehicles, the road, the weather, and what officers saw. Ask for a copy and read it closely. Write down anything that looks wrong.

Scene details change quickly. Traffic backs up, skid marks fade, and witnesses move on. Photos and names collected soon after a crash help capture what the road looked like. Driver testing records can also matter as evidence: under 49 CFR 382.303(e), a truck driver who is subject to post-accident testing has to stay readily available for it, or the employer may treat that driver as having refused to submit to testing, though this does not require delaying necessary medical attention for injured people or bar the driver from leaving the scene as long as needed to get help responding to the accident or to get necessary emergency medical care.

Our team can request and review these materials for you. We can also help organize medical bills, work records, and photos. That way, you don’t have to chase every record alone.

What the Free Consultation Covers

Your first consultation is free, confidential, and carries no obligation to continue. It gives you a chance to ask questions before you decide anything.

Bring what you have. That includes the crash date and location, the other vehicle’s information if you know it, and the trucking company’s name if it appeared on the truck. It also includes medical summaries, photos, and any letters from insurers. Missing items are fine. The consultation is a place to start.

Quick Answers

Is the first consultation free? Yes.
