Common Causes of Catastrophic Injury in New Mexico<\/h2>\n

Car and motor vehicle crashes are a common source, including high-speed impacts and rollovers. Under NMSA 1978, \u00a7 66-7-201<\/a>, a driver in a crash that results in injury to or death of any person must immediately stop at the scene or as close as possible, and must remain at the scene until the requirements of Section 66-7-203 NMSA 1978 are fulfilled.<\/p>\n

Trucking accidents involve large commercial vehicles. The federal hours-of-service and electronic logging device rules for commercial<\/a> truck drivers are often cited when a trucking claim is reviewed.<\/p>\n

Premises liability cases involve unsafe property conditions, such as serious falls. Under UJI 13-1309 NMRA<\/a>, an owner or occupant owes a visitor a duty to use ordinary care to keep the premises safe. The committee commentary says this duty applies even when a danger is known or obvious, but there may be circumstances in which a visitor\u2019s own negligence, resulting in injury from an obviously dangerous condition, is unforeseeable.<\/p>\n

Negligent security cases involve harm that a property could have foreseen. When a property does not provide reasonable security, a person can be seriously hurt. These cases ask what the property knew and what steps it took.<\/p>\n
