A negligence claim generally needs a duty owed, a breach of that duty, and a breach that caused the harm. Herrera v. Quality Pontiac states these elements.

Causation matters too. Under the same case, a proximate cause produces the harm in a natural and continuous sequence. The harm would not have happened without it. It does not have to be the only cause.

El Gringo Law handles car accidents, trucking accidents, premises liability, negligent security, and wrongful death. Fatal events in those areas can lead to these claims. The damages section below explains what the statute allows the family to recover.

Who Can Bring the Claim and Who May Be Responsible

A wrongful death action is brought by the personal representative of the person who died, in that person’s name. NMSA 1978, § 41-2-3 sets this rule. The claim is filed in that name, not by each family member on their own.

The statute also says the judgment is not liable for the deceased person’s debts, provided the decedent has left a spouse, child, father, mother, brother, sister, or child or children of a deceased child, as defined in the New Mexico Probate Code. It lists who receives the money, starting with a surviving spouse and children or grandchildren. Other relatives follow in the order the statute sets. It lists who receives the money, starting with a surviving spouse and children or grandchildren. Other relatives follow in the order the statute sets.

Responsibility may fall on an at-fault driver, a trucking company, a property owner, or a security provider. Which party applies depends on how the death happened.

A company that lets a driver use its vehicle can also face a claim. A negligent entrustment claim requires that the company entrusted the vehicle to the driver, knew or should have known the driver was incompetent, and that the incompetence caused the injury. DeMatteo v. Simon sets out those elements.

New Mexico generally limits each defendant to its own share of fault. A defendant that shows another’s fault contributed to the harm is liable only for its own share of the total damages. Under NMSA § 41-3A-1, joint and several liability is abolished in causes of action to which comparative fault applies, except as otherwise provided hereafter in the statute. Identifying every party early matters, since each may carry different insurance coverage.

Common Causes of Wrongful Death in Bernalillo County

Wrongful death claims in Bernalillo County can arise from crashes on public roads and from deaths on unsafe property.

Interstate 25 and Interstate 40 both pass through the Albuquerque area. A crash on either route can involve passenger cars, commercial trucks, or both.

Crashes involving commercial trucks raise extra questions. Under 49 C.F.R. § 395.3, a driver of a property-carrying commercial motor vehicle may not drive without first taking 10 consecutive hours off duty, may not drive after a 14-consecutive-hour period that begins when the driver comes on duty following 10 consecutive hours off duty, and may drive a total of 11 hours during that period. Federal law also requires motor carriers to meet minimum financial responsibility levels for public liability under 49 U.S.C. § 31139. Families can ask who employed the driver and who owned the truck.

Deaths can also happen on property. A landowner has a duty to use ordinary care to protect visitors from harm caused by a third party’s foreseeable conduct. That conduct can be negligent, intentionally wrongful, or criminal. UJI 13-1320 NMRA states this duty. These claims can arise at apartment complexes, parking areas, and commercial properties.

Damages Available Under NMSA 41-2-3

A New Mexico jury may award compensatory and exemplary damages that it deems fair and just. NMSA 1978, § 41-2-3 sets this rule. Compensatory damages pay for a loss. Exemplary damages are extra damages the jury may award.

The jury considers the pecuniary injury, meaning financial loss, to the surviving family member entitled to the judgment. It also weighs mitigating or aggravating circumstances. Those are facts that make the wrongful act less or more serious.

Some relatives may have a separate loss of consortium claim, which means the loss of a close relationship. Thompson v. City of Albuquerque holds that these damages belong to the claimant, not to the injured person or the decedent’s estate.

Start a file early. Keep receipts, bills, pay records, and notes about what the person contributed to the household. These records help show the financial side of the loss. How much a jury awards turns on the evidence in each case, so no general article can predict a figure.

How Long You Have to File in New Mexico

A wrongful death action has to be commenced within three years of accrual, and the cause of action accrues as of the date of death (NMSA § 41-2-2). The cause of action accrues as of the date of death. NMSA § 41-2-2 sets a three-year period that begins when the cause of action accrues, and the cause of action accrues as of the date of death.

The clock starts on the date of death. It does not wait for a crash report, an insurance decision, or the end of talks with an insurer.

Write the date of death on a calendar now. Funerals, medical bills, and insurance calls can crowd out everything else. A calendar note keeps the deadline visible. Tell other family members the date too, since several people may be helping with the claim.

Delays in gathering records or identifying the responsible party can use up time that the period allows. Starting early leaves more room to act.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Steps to Take in the First Weeks After a Death in Bernalillo County

In the first weeks, families should gather records, preserve evidence, and log every insurer contact. Start with the official reports and keep notes on everything that follows.

Ask the agency that responded for any crash or incident report. In Bernalillo County, that may be the Albuquerque Police Department or the Bernalillo County Sheriff’s Office, depending on where the death happened.

Some accident reports are confidential under New Mexico law. NMSA § 66-7-213 provides that accident reports made by persons involved in accidents are without prejudice to the person reporting and are for the confidential use of the state highway and transportation department and other state agencies with a use for the records, subject to the exceptions stated in the section. The statute also bars using an accident report as evidence in any civil or criminal trial arising out of an accident, except as the section otherwise provides.

Save photos, vehicle or property details, witness names, and any messages or video about the event. Keep the originals when you can. A simple folder or notebook works well. The goal is a clear record that anyone helping with the claim can read.

Keep a written log of every insurer call or letter. Note the date, the person’s name, and what was said. Ask for copies of medical records and bills as they arrive, and file them in one place.

Insurance Adjusters and Early Settlement Offers

An insurance adjuster works for the insurance company, not for your family. Keep that in mind on the first call.

New Mexico lists unfair claims practices. Under NMSA 59A-16-20, one listed unfair claims practice is failing to attempt, in good faith, prompt, fair, and equitable settlements when liability is reasonably clear. The statute’s text applies to an insured’s claims. NMSA § 59A-16-20 defines certain claims practices by an insurer or other person as unfair and deceptive practices and prohibits them when they are knowingly committed or performed with such frequency as to indicate a general business practice.

Suing an insurer over how it handled a claim has limits. Under Hovet v. Allstate, a third-party claimant may file an unfair settlement practices action only after the underlying negligence case ends with a judicial finding of fault against the insured.

Before accepting any offer, ask for the proposal in writing. Make sure you know the full scope of your family’s losses first. Read any release, which is a document that gives up future claims, before you sign it. You can tell the adjuster you need time to review.

Frequently Asked Questions About Wrongful Death in Bernalillo County

Here are short answers to common questions about wrongful death claims in Bernalillo County and across New Mexico.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do families have to file a wrongful death case?

Under NMSA § 41-2-2, an action has to be commenced within three years of accrual, and the cause of action accrues as of the date of death (NMSA 1978, § 41-2-2 — three years from the date of death).
