Families searching for wrongful death Sandoval County information often ask the same questions: who can file, how long they have, and who pays. This guide answers those questions under New Mexico law.

What a Wrongful Death Claim Means in New Mexico

A wrongful death claim is a civil lawsuit filed after a person dies because another party’s wrongful act, neglect or default caused the death. Under NMSA § 41-2-1, a person or corporation that would have been liable for an injury can be sued for damages notwithstanding the death of the person injured.

These claims often arise from a car crash, a trucking accident, an unsafe property condition, negligent security, or a sexual assault. The family must show the other party’s conduct was a proximate cause of the death. A proximate cause is one that, in a natural and continuous sequence, produces the injury, and without which the injury would not have occurred (Herrera v. Quality Pontiac).

A civil claim is separate from any criminal case against the at-fault person. The claim exists for the people left behind, not for the person who died.

If your family lost someone in a Sandoval County crash or incident, you may have a claim, and our team can walk through your options with you. New Mexico law says every wrongful death action is brought by and in the name of the personal representative (NMSA 1978, § 41-2-3).

The personal representative files for the family members the law names. The statute lists who receives any judgment, in order. A surviving spouse comes first in many cases. Children and grandchildren share in other cases. Parents and siblings take only in certain situations.

Families should find out early who is serving as the personal representative. That person signs and files the claim, so knowing who it is helps the family plan next steps.

How Long Families Have to File in New Mexico

Families have three years from the date of death to file a wrongful death action (NMSA § 41-2-2). The statute says the action must be brought within three years, and the claim accrues on the date of death (NMSA § 41-2-2).

Shorter clocks can apply when a government entity is involved. Under New Mexico’s Tort Claims Act, a tort action against a governmental entity or a public employee must be commenced within two years after the date of the occurrence that resulted in the loss, injury or death, except that a minor under the full age of seven years has until his ninth birthday to file (NMSA § 41-4-15). For a wrongful death claim against a government entity, written notice may be due within six months after the date of the occurrence of the injury that resulted in the death (NMSA § 41-4-16). The notice rule does not apply if the government entity already had actual notice of the occurrence.

Because each defendant can carry a different deadline, families should not wait to have the dates reviewed.

Who Pays a Wrongful Death Claim

A wrongful death claim is brought against the party whose fault caused the death. The family does not pay that party. Depending on the facts, the responsible party may be a driver, a trucking company, a property owner, or a security contractor.

New Mexico uses several liability in most cases. Under NMSA § 41-3A-1, except in the situations listed in its subsection C, a defendant who shows that another’s fault was a proximate cause of the plaintiff’s injury is liable only for the portion of the damages equal to that defendant’s fault divided by the total fault attributed to all persons. Joint and several liability still applies in listed situations, such as intentional injury and vicarious liability. Under NMSA § 41-3A-1, in any cause of action to which the doctrine of comparative fault applies, the doctrine imposing joint and several liability upon two or more wrongdoers whose conduct proximately caused an injury to any plaintiff is abolished except as otherwise provided hereafter.

Trucking cases add federal rules.

Vehicle owners can also be defendants. Who pays in the end depends on the facts of each case.

Wrongful Death Cases Arising in Sandoval County

Wrongful death claims in Sandoval County can arise from highway crashes, commercial truck collisions, and incidents on private property. Sandoval County includes Rio Rancho, the Town of Bernalillo, Corrales, and Placitas. Trips between these communities and Albuquerque can involve busy roads.

The University of New Mexico Traffic Research Unit publishes New Mexico crash data, including county breakdowns for Sandoval County (UNM Traffic Research Unit). Crash data shows where collisions happen, but each case turns on its own facts.

Where the incident happened can affect who the responsible parties are. It can also show whether a government entity is involved. Families should gather the crash report, any photos, and the names of witnesses early.

Damages Families May Pursue in a New Mexico Wrongful Death Case

A New Mexico jury can award compensatory and exemplary damages that it finds fair and just. The jury may consider the pecuniary injury resulting from the death to the surviving party entitled to the judgment, and the mitigating or aggravating circumstances attending the wrongful act (NMSA § 41-2-3).

New Mexico also recognizes loss of consortium claims for close family members. The key question is whether the relationship was mutually dependent. Courts look at factors like how long the relationship lasted, whether the people shared a household, and their emotional reliance on each other (UJI 13-1810A NMRA). These damages belong to the family member, not to the estate (Thompson v. City of Albuquerque).

Every case is different. Past results do not predict the value of a new claim.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Expect at a Free Consultation

The first consultation with El Gringo Law is free and confidential, with no obligation to continue.
