It changes how a person works, moves and handles daily life. Serious crashes, trucking collisions, falls on property and violence can all cause this kind of harm. What Does Catastrophic Injury Mean?<\/h2>\n

A catastrophic injury causes lasting harm to health, work and independence. The term describes the size of the loss, not one diagnosis. A broken bone may heal in months. A catastrophic injury may need surgery, rehabilitation, equipment and home changes for years.<\/p>\n

The term matters in a legal claim because it shows the full cost of the harm. That can include future medical care, rehabilitation and income a person can no longer earn. A claim that counts only bills already paid can miss much of the real loss.<\/p>\n

Common Examples of Catastrophic Injuries<\/h2>\n

Examples include spinal cord injuries, amputations, severe burns, and serious brain, bone and organ injuries. Each one can bring long treatment and lasting limits.<\/p>\n

The spinal cord carries signals between the brain and the rest of the body. Cerebrospinal fluid surrounds it to cushion it against shock. Nerves are named by where they leave the spine. Cervical nerves control the neck, shoulders, arms, hands and diaphragm. An injury between C1 and C4 can stop breathing, because those nerves drive the diaphragm. Where an injury sits in the spine shapes what a person can feel and move. Amputation brings a different course. Fitting, therapy and adjustments to a prosthetic can continue for a long time as the body and daily needs change. Severe burns can mean long treatment and scarring that lasts. Serious brain, bone and organ injuries can leave limits that are hard to see from the outside.<\/p>\n

How Catastrophic Injuries Happen in Santa Fe<\/h2>\n

Catastrophic injuries Santa Fe families face often start with a crash, a fall, a trucking collision, a security failure or an assault. Each situation raises different legal questions.<\/p>\n

Santa Fe County roads carry commuters, visitors and commercial trucks. The UNM Traffic Research Unit<\/a> prepares New Mexico crash data for NMDOT, with breakdowns that include Santa Fe County.<\/p>\n

When a commercial truck is involved, federal rules matter. Except as otherwise provided in \u00a7 395.1<\/a>, 49 CFR \u00a7 395.3<\/a> provides that a driver of a property-carrying commercial motor vehicle may not drive without first taking 10 consecutive hours off duty, and may not drive after a period of 14 consecutive hours after coming on-duty following 10 consecutive hours off-duty. Those records can be important to a trucking claim.<\/p>\n

For premises injuries, New Mexico’s pattern instruction says an owner or occupant owes a visitor a duty of ordinary care. Where a dangerous condition was open and obvious, the instruction adds that the owner’s duty still applies, under UJI 13-1318 NMRA<\/a>.<\/p>\n

Negligent security cases ask whether weak protection contributed to violence on the property. Sexual assault and wrongful death cases involve severe harm, and families often face a loss they never expected.<\/p>\n

How Catastrophic Injuries Differ From Other Injuries<\/h2>\n

Catastrophic injury claims carry long-term needs that are hard to measure on day one. Medical needs can include surgery, rehabilitation, equipment and home changes. Lost income can last far beyond the first months after the accident.<\/p>\n

That makes documentation important. Early medical records show what happened. A daily log of pain, limits and tasks you can no longer do shows how life has changed. Future care needs should be written down, not only costs already paid.<\/p>\n

New Mexico law also looks at cause. A proximate cause is one that, in a natural and continuous sequence, produces the injury. It need not be the only cause, or the last or nearest one. Herrera v. Quality Pontiac<\/a> states this rule.<\/p>\n

Family members may have their own claims. Depending on the relationship and the circumstances, a spouse or another close relative may be able to bring a separate claim, known as loss of consortium, for the loss of companionship and support caused by the injury.<\/p>\n\n

Deadlines and Early Steps After a Serious Injury<\/h2>\n

Deadlines matter, and they differ by claim type. For a wrongful death case, NMSA \u00a7 41-2-2<\/a> requires that the action be brought within three years after the cause of action accrues, and the cause of action accrues as of the date of death (NMSA<\/a> 1978, \u00a7 41-2-2<\/a> — three years from the date of death). The cause of action accrues as of the date of death.<\/p>\n

Claims against a government body can follow shorter notice rules. Under NMSA \u00a7 41-4-16<\/a>, a person who claims damages from the state or a local public body under the Tort Claims Act is required to present written notice, within ninety days after an occurrence giving rise to a claim for which immunity has been waived, describing the time, place and circumstances of the loss or injury. The notice goes to the risk management division for claims against the state, the mayor for claims against a municipality, the superintendent for claims against a school district, the county clerk for claims against a county, or the administrative head of any other local public body for claims against that body. The statute also provides that a suit is not barred where the governmental entity had actual notice of the occurrence, and that the time for giving notice does not include up to ninety days during which the injured person is incapacitated from giving notice by reason of injury. For a wrongful death claim, notice may be presented by, or on behalf of, the personal representative of the deceased person, any person claiming benefits of the proceeds of a wrongful death action, or the consular officer of a foreign country of which the deceased was a citizen, within six months after the date of the occurrence of the injury which resulted in the death.<\/p>\n

If you were in a crash with injuries, New Mexico law sets a reporting step. Under NMSA \u00a7 66-7-207<\/a>, the driver of a vehicle involved in an accident resulting in bodily injury, death, or total property damage to an apparent extent of five hundred dollars ($500) or more shall, within five days after the accident, forward a written report of the accident to the department of transportation.<\/p>\n
