A catastrophic injury is serious harm with lasting or permanent effects. This guide explains what the term means, which New Mexico deadlines matter most, and what evidence to protect early. It is general information about New Mexico law, so your own facts will shape the next steps.

What Makes an Injury Catastrophic

A catastrophic injury is serious harm with lasting or permanent effects. It is more than a broken bone that heals over time.

Common examples include spinal cord injuries, traumatic brain injuries, amputations, severe burns, and multiple serious fractures or organ injuries.

The label depends mostly on long-term impact, not on how the injury looks at the scene. Ask four questions. Can the person walk, think clearly, and work? Can they care for themselves at home? How much daily help will they need? What will the future look like?

Some injuries look less serious at first, and the full picture takes time to form. Keep every medical record, follow-up visit, and symptom note. Those records help show the whole impact of the injury.

Our catastrophic injuries page explains the broader category.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Catastrophic Injuries Happen on Rio Rancho and Sandoval County Roads

Serious injuries here often start with a high-speed collision, an intersection crash, or a pedestrian struck by a vehicle. Local news outlets regularly report serious crashes in Rio Rancho and nearby Sandoval County. Those reports show how quickly an ordinary drive can change.

Large commercial trucks add another layer. A truck crash can involve more than one company, a driver’s work logs, and detailed maintenance records. Those facts shape how a claim is built.

Serious injuries also happen on property. A fall on a poorly maintained floor or a burn at a commercial site may be a premises case. New Mexico’s slip-and-fall jury instruction says an owner or occupant owes a visitor the duty to exercise ordinary care to keep the premises safe for the visitor’s use.

The firm also handles premises liability and negligent security matters. If you were hurt elsewhere in Sandoval County, read our Sandoval County injury guide. Where and how the crash happened matters as much as the injury itself.

Spinal Cord, Brain, Amputation, and Burn Injuries: What Families Often Face

These injuries often change daily routines first, then work and money.

The spinal cord is protected by layers of tissue and fluid. Injury to it can affect movement, feeling, and more. The NINDS spinal cord injury overview explains that nerves in the upper neck control the diaphragm, the main muscle for breathing. An injury high on the spine can therefore affect breathing.

Traumatic brain injuries can affect memory, mood, focus, and speech. Families often notice these changes at home first.

An amputation can mean prosthetic fittings, long therapy, and changes to the home or vehicle. Severe burns can bring long treatment and rehabilitation.

Work changes too. Some people return to the same job. Others need a new role or cannot work at all. Those choices affect income, benefits, and plans for the future.

Caregiving often shifts to a spouse, parent, or adult child. That person may cut work hours or take on tasks they never expected. The emotional load can be heavy for everyone in the household. See our pages on spinal cord injuries, amputations, and burn injuries.

Losses That May Be Part of a Claim in New Mexico

A catastrophic injury claim can include many kinds of loss, depending on the facts.

Losses that may be part of a claim include past and future medical care, rehabilitation, assistive equipment, home or vehicle changes, lost wages, reduced ability to earn, and pain and suffering.

Future needs are often estimated with help from doctors and other professionals. That is one reason early medical documentation matters. Keep receipts, mileage logs, and pay stubs too.

Close family members may have their own claim. They do not belong to the injured person or the decedent’s estate.

If someone died, a wrongful death case must be brought by the personal representative of the person who died. Under § 41-2-3, the proceeds of a wrongful death judgment shall not be liable for any debt of the deceased and, where the decedent left a spouse, child, father, mother, brother, sister, or child or children of a deceased child, shall be distributed in the order the statute lists. The proceeds are not liable for the deceased person’s debts.

Every case is different, and the facts decide which losses fit. No one can predict a specific amount.

Have questions about what happened?

Ask our team directly. The notice must state the time, place, and circumstances of the loss. Under § 41-4-16, no suit or action for which immunity has been waived under the Tort Claims Act may be maintained against the state or a local public body unless notice has been given as required, or unless the governmental entity had actual notice of the occurrence. For a wrongful death claim against a government entity, the notice may be presented within six months after the injury.

Fault rules matter too. Under Scott v. Rizzo, New Mexico uses pure comparative negligence: an injured person’s own share of fault reduces the damages by that percentage but never bars recovery, so even a person found mostly at fault can recover the share caused by others. New Mexico follows pure comparative negligence, which means shared fault (the injured person’s own share) reduces recovery rather than erasing it.

Under the several liability statute, § 41-3A-1, in causes of action to which several liability applies, a defendant who establishes that the fault of another is a proximate cause of the plaintiff’s injury is liable only for the portion of the damages equal to the ratio of its fault to the total fault attributed to all persons. Some exceptions apply. Timing questions turn on specific facts, so ask early.

Evidence to Protect After a Serious Crash or Incident

The evidence you keep early often matters most.

Start with the police or incident report number. Take photos of the scene, the vehicles, the property condition, and your injuries. Write down the names and contact details of witnesses. Keep a written record of every medical visit and symptom.

New Mexico law also sets a report timeline for injury crashes. Under § 66-7-207, the driver of a vehicle involved in an accident resulting in bodily injury to or death of any person, or total property damage to an apparent extent of five hundred dollars ($500) or more, must, within five days after the accident, forward a written report of the accident to the department of transportation.

Vehicle damage, phone records, and property conditions can change fast. Ask early for what you need.

Commercial truck cases add federal records. Under 49 CFR § 395.8, except for a private motor carrier of passengers (nonbusiness), motor carriers subject to the requirements of this part must require drivers to record duty status for each 24-hour period. After certain commercial motor vehicle crashes on a public road, 49 CFR § 382.303 requires each employer to test each surviving driver for alcohol and for controlled substances as soon as practicable, but only in the circumstances the rule lists, such as a fatality or a citation issued within the time limits the rule sets for an injury treated away from the scene or a tow-away. If an alcohol test is not given within two hours, the employer must keep a record of the reasons.

Those records matter, so early requests help. Learn more on our trucking accidents page.

Keep a simple journal too. Note pain levels, daily limits, sleep problems, and work you missed.

Talking With El Gringo Law About Your Injury

El Gringo Law offers a free initial consultation that is confidential and carries no obligation to continue.

The firm handles car accidents, trucking accidents, premises liability, negligent security, wrongful death, sexual assault, catastrophic injuries, spinal cord injuries, amputations, and burn injuries.

Josh Wood is the lawyer responsible for this page’s content.
