Who May Share Responsibility After a Delivery Vehicle Crash<\/h2>\n

The driver, the company that directed the route, a contractor or carrier, and the vehicle’s owner or lessor can each be part of a claim. Who gets named depends on how the delivery work was arranged.<\/p>\n

Delivery work is set up in different ways. A driver may be a direct employee, an independent contractor, or someone working for a third-party carrier. A broker that chose that carrier may also be involved.<\/p>\n

Under UJI 13-1647 NMRA<\/a>, a negligent hiring, supervision or retention claim requires proof. The employer knew or should have known the driver would create an unreasonable risk of injury to a group or class that includes the plaintiff, failed to use ordinary care, and that the employer’s negligence was a cause of the plaintiff’s injury. New Mexico’s pattern jury instruction for negligence in hiring, supervising, or retaining an employee, UJI 13-1647 NMRA<\/a>, states that the plaintiff “has the burden of proving the following.”<\/p>\n

Fault can be shared. Under UJI 13-2219 NMRA<\/a>, the jury assigns a percentage of negligence to each person whose negligence caused harm, including the injured person. Where the doctrine of comparative fault applies, Section 41-3A-1 of the New Mexico Statutes<\/a> abolishes joint and several liability except as the statute otherwise provides, and the liability of such defendants is several. A defendant who establishes that another’s fault was a proximate cause of the plaintiff’s injury is then liable only for its share of the total damages, based on its fault compared with the total fault of all persons, including plaintiffs, defendants and persons not party to the action. Joint and several liability still applies in some situations, including to persons whose relationship makes one vicariously liable for the acts of the other, but only to that portion of the total liability attributed to those persons. New Mexico adopted comparative negligence in Scott v. Rizzo<\/a> (1981).<\/p>\n
