A bus crash claim seeks payment for injuries or a death caused by a bus collision. The injured person might be a passenger, a pedestrian struck by a bus, or a family member of someone who died. Fault depends on the facts. Deadlines apply to injury and wrongful death claims, so timing matters. This page explains who may be responsible, what a claim can cover, and what happens after you contact El Gringo Law.

What a Bus Crash Claim Covers in Albuquerque

A bus crash claim covers people hurt by a bus, or the family of someone a bus killed. It usually covers three groups:

Passengers hurt during a sudden stop, a turn, or a collision.

Pedestrians and other road users struck by a bus.

Families of a person killed in a bus crash.

Bus crashes often raise the same questions as car and trucking cases. Who was driving? Who employed the driver? What safety rules applied? Our team handles car accident claims and trucking accident claims across New Mexico, and a bus crash can fall within either area. Waiting to see whether an injury improves is a common mistake. Delay can cost time and evidence. When you call, we review the facts with you and explain whether a claim may fit.

If a bus struck you or someone you love in Albuquerque, you may have a claim worth reviewing, and we can talk it through with you. An employer can answer for a driver’s negligence while the driver is working. A company can also face claims about how it hired, trained, or kept a driver. Responsibility can be shared. A cause of injury does not have to be the only cause to count, as explained in Herrera v. Quality Pontiac.

Pedestrians have specific rules. When traffic signals are not operating, a driver must yield to a pedestrian who is in a crosswalk, under NMSA § 66-7-334. A pedestrian should not suddenly leave a curb into a vehicle’s path when the driver cannot yield.

Public buses follow different steps. NMSA § 66-7-334 sets pedestrian right-of-way rules at crosswalks when traffic signals are not in place or not in operation, and it does not address when the Tort Claims Act applies to city, county, or transit buses. Under NMSA § 41-4-5, the immunity granted by Subsection A of § 41-4-4 does not apply to bodily injury, wrongful death or property damage caused by the negligence of public employees acting within the scope of their duties in the operation or maintenance of a motor vehicle. NMSA 1978, § 41-4-5 reads: “The immunity granted pursuant to Subsection A of Section 41-4-4 NMSA 1978 does not apply to liability for damages resulting from bodily injury, wrongful death or property damage caused by the negligence of public employees while acting within the scope of their duties in the operation or maintenance of any motor vehicle, aircraft or watercraft.” Notice stating the time, place and circumstances of the loss must be presented within ninety days after the occurrence giving rise to the claim (NMSA § 41-4-16). The statute does not count up to ninety days during which the injured person is incapacitated from giving notice by reason of injury, and a suit may proceed without that notice if the governmental entity had actual notice of the occurrence. For a wrongful death claim, the notice may be presented within six months after the date of the occurrence of the injury which resulted in the death.

Evidence often decides fault. Useful evidence includes maintenance and inspection records, driver hours, onboard or dash video, and witness names. Federal hours-of-service rules limit how long drivers of property-carrying commercial motor vehicles may drive and remain on duty. Federal bus safety rules also require baggage to be secured so it cannot injure riders.

Injuries and Damages in a Bus Crash Claim

A bus crash claim can seek payment for medical care, lost income, and pain and suffering caused by the crash. Some bus crashes cause severe harm. Our practice covers catastrophic injuries, spinal cord injuries, amputations, and burn injuries. Ongoing care, changes to a home, and lost ability to earn may also be part of a claim.

Wrongful death claims work differently. Under NMSA § 41-2-1, a death caused by another’s wrongful act can lead to an action for damages. The action is brought by the personal representative of the deceased (NMSA § 41-2-3).

The value of any claim depends on the injuries, the medical record, and the facts of the crash. No one can predict a dollar figure from a web page.

How a Bus Crash Case Works: Steps and Timing

A bus crash case usually moves through five steps, from first call to final resolution.

Consultation. We talk through the crash, your injuries, and any papers you have. You decide whether to move forward.

Evidence requests. We ask for records and send preservation letters, because video and logs can be lost.

Medical records. We gather records from your treating providers so your injuries are documented.

Claim presentation. We present the claim to the insurer or responsible party and negotiate. If needed, we file a lawsuit.

Resolution. The case ends in a settlement or a trial. You make key decisions at each stage.

What decides how long a case takes? The injuries, the treatment timeline, and whether fault is disputed are the main factors.

Deadlines set the pace. New Mexico generally allows three years for an injury to the person (NMSA § 37-1-8). A wrongful death action must be brought within three years after the date of death (NMSA § 41-2-2). Because these dates differ, check them early.

Why Choose El Gringo Law for a Bus Crash Claim

El Gringo Law is a bus crash lawyer Albuquerque residents can contact to review a crash, the fault question, and the deadlines.
