They can follow car crashes, truck collisions, unsafe property, negligent security incidents, and fatal accidents. This page explains what to expect, which New Mexico deadlines matter, and what evidence helps. Josh Wood is the responsible lawyer for this page.

What Counts as a Catastrophic Injury in Bernalillo County

A catastrophic injury is severe harm that may be permanent and usually needs ongoing care. Spinal cord injuries, amputations, and burn injuries are common examples, and El Gringo Law handles all three.

Spinal cord damage shows why these injuries are so serious. The NINDS spinal cord injury information explains that three layers of protective tissue surround the spinal cord, and cerebrospinal fluid cushions it against shock. Injury between the C1 and C4 segments can halt breathing, because those nerves control the diaphragm and lung expansion.

The first hospital picture may not be the whole picture. Recovery can involve surgery, rehabilitation, medical equipment, and changes at home or to a vehicle. The full scope of the harm may take months to become clear. Keep every bill, prescription, therapy note, and receipt from the start. Those records show what your injury needs over time, not just on the day of the crash.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Where Bernalillo County Crashes Lead to Catastrophic Injuries

Serious crashes that lead to catastrophic injuries in Bernalillo County happen on Albuquerque city streets, on interstates such as I-25 and I-40, and on roads outside city limits. Each setting brings different speeds, traffic patterns, and emergency response times.

Intersection collisions, high-speed impacts, rollovers, and strikes involving pedestrians or cyclists can each cause serious harm. One crash can involve several drivers, a commercial truck, and emergency crews at the same scene. That mix can mean several insurers, several accounts of what happened, and more records to gather. Early records from the scene, the hospital, and the crash report work together.

Those patterns show where crashes cluster across the state. Your own crash facts are what matter in a claim.

Fault is the core question. New Mexico’s negligence framework generally requires a duty owed to the injured person, a breach of that duty, and a breach that was a proximate cause (a legal cause tied directly to the harm). The Herrera v. Quality Pontiac decision sets out this rule. A proximate cause need not be the only or the nearest cause of the injury.

How Sheriff’s Deputies and First Responders Document a Crash

The Bernalillo County Sheriff’s Office and other responding agencies, including fire and rescue crews, often create the first written record of a crash scene. Their notes can shape what the claim looks like later.

Officers and crews may record scene conditions, measurements, photographs, witness names, and what they saw. Their findings can matter when a claim is reviewed. Reports also follow a formal path. Under Section 66-7-207, a driver in a crash involving bodily injury, death, or total property damage of $500 or more must forward a written report within five days. A law enforcement officer must forward a written report within twenty-four hours after completing the investigation.

A common mistake is assuming the report settles fault. Under Section 66-7-213, accident reports are for the confidential use of the state highway and transportation department or other state agencies having use for the records for accident prevention purposes or for the administration of the laws of this state relating to the deposits of security and proof of financial responsibility by persons driving or the owners of motor vehicles. Except as that section allows, a report generally cannot be used as evidence at a civil or criminal trial about the accident.

What you say also matters. Statements at the scene and recorded statements to an insurer can affect how a claim is evaluated. Many people feel pressure to talk right away. Talking with a lawyer before giving a recorded statement is worth considering.

Trucking, Premises, Negligent Security, and Wrongful Death Situations

Each of these situations turns on a different question: who owed a duty, and what that duty required. The answer shapes which records and witnesses matter most.

Federal hours-of-service rules govern commercial truck drivers’ time behind the wheel and their electronic logs. The federal hours-of-service rules limit how long a driver of a property-carrying commercial motor vehicle may drive. Driver logs, maintenance records, and the number of companies or insurers involved can matter in a truck case. That takes a review of the records.

Premises cases work differently. Under UJI 13-1318, an owner or occupant owes a visitor the duty to use ordinary care to keep the premises safe. That duty applies whether or not a danger is obvious. Unsafe stairs, wet floors, and poor lighting are common examples.

Negligent security claims ask whether a property lacked reasonable security. Details like the layout, prior incidents on the property, and the security in place at the time often matter.

A wrongful death claim follows a fatal injury. Under Section 41-2-3, the action is brought by and in the name of the personal representative of the deceased person. A personal representative is the person appointed to manage the decedent’s estate. Under the statute, the judgment is distributed to listed family members in the order set by who survives; if there is no kindred as named in Subsections A through E, the proceeds are disposed of in the manner authorized by law for the disposition of the personal property of deceased persons.

Have questions about what happened?

Ask our team directly. A wrongful death action has its own three-year limit that starts on the date of death. Under Section 37-1-8, an action for an injury to the person must be brought within three years. Under Section 41-2-2, a wrongful death action must be brought within three years after the cause of action accrues, and it accrues as of the date of death (§ 41-2-2 — three years from the date of death).

Which rule fits a given case depends on the facts. Claims involving a city, county, or state agency can follow different rules, so raise that early with a lawyer.

Useful evidence often includes photos, vehicle or property damage, medical records and bills, witness names, pay records showing lost income, and the crash or incident report. Gathering early helps keep these records complete.

Does fault stop me from recovering in New Mexico?
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Who brings a wrongful death claim in New Mexico?

The personal representative of the deceased person brings it, under New Mexico law.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What should I gather first?

Start with photos, medical records, bills, and witness names.
