You got in a car accident. You are wondering if you really need a lawyer, or if you can just deal with the insurance company yourself and keep the attorney’s fee. It is a fair question, and I am going to give you an honest answer even though I am a personal injury attorney and the obvious answer benefits me.
The truth is that sometimes you can handle a claim on your own. But most of the time, trying to do it yourself costs you more money than an attorney’s fee ever would.
When You Might Be Able to Handle It Yourself
If your accident was clearly the other driver’s fault, your injuries are genuinely minor like some soreness that resolved in a few weeks, your medical bills are under $2,000 to $3,000, you did not miss significant time from work, and the insurance company is offering a reasonable amount that covers your actual expenses, then you may be able to settle this on your own without giving up significant value.
In cases like these, the insurance company’s offer might be in the range of what an attorney would negotiate anyway, and you would keep the full amount instead of paying a contingency fee.
When You Definitely Need a Lawyer
The situations where people lose the most money by going it alone include any case involving more than minor injuries. If you needed imaging like an MRI or CT scan, had physical therapy, saw specialists, missed more than a few days of work, or are still dealing with pain weeks after the accident, your case has significant value that the insurance company will try to minimize.
If fault is disputed at all, you need representation. New Mexico’s comparative negligence system means that every percentage point of fault they can pin on you reduces your payout. Insurance adjusters are trained to get you to say things that shift blame onto you. An attorney knows how to prevent that.
If the other driver was uninsured or underinsured, the claim process becomes significantly more complex and involves your own insurance company, which has its own financial incentive to pay less. If you were hit by a commercial truck, a rideshare vehicle, or a government vehicle, the legal landscape is entirely different and you should not navigate it alone.
What the Insurance Company Is Counting On
Here is something most people do not understand: insurance companies love it when you do not have a lawyer. Studies consistently show that claimants with attorneys recover significantly more money than those without, even after the attorney’s fee is deducted.
The insurance company knows this. When you call them without a lawyer, they know they can offer you less because you do not know what your case is actually worth, you do not know the tactics they use to reduce your payout, you probably do not know how to calculate future medical costs and non-economic damages, and you have no leverage because you cannot credibly threaten a lawsuit.
Their first offer is almost never their best offer. It is a test to see if you will take less. An attorney who handles these negotiations daily knows exactly how far to push.
The Math That Actually Matters
People avoid hiring a lawyer because they do not want to pay the contingency fee, typically around 33 percent. But consider this example.
You handle the claim yourself and the insurance company offers you $15,000. You keep all of it. Or you hire an attorney who negotiates the same claim to $45,000. After their 33 percent fee, you keep $30,000. You just made $15,000 more by hiring a lawyer.
This is not a hypothetical. This is what happens in case after case. The insurance company’s opening offer to an unrepresented claimant is almost always a fraction of what they will pay when an attorney is involved.
What About Those Lawyer Ads Promising Millions?
Every PI firm advertises their biggest settlements and verdicts. Multi-million dollar results are real, but they come from catastrophic injury cases, not typical car accidents. Do not choose a lawyer based on the biggest number in their advertising. Choose one based on how they treat people with cases like yours.
Ask how they handle communication, what their actual experience is with cases similar to yours, and whether you will be working with the actual attorney or getting passed to a paralegal. Choosing the right attorney is about fit, not flashiness.
At Least Get a Free Consultation
Here is the bottom line: a free consultation costs you nothing and takes 15 to 30 minutes. In that conversation, an experienced attorney can tell you whether your case has value beyond what the insurance company is offering, what your claim is likely worth, and whether hiring a lawyer makes financial sense for your specific situation.
If we tell you that you do not need a lawyer, we will tell you that honestly. We would rather earn your trust and have you refer us to someone who does need help than take a case where we cannot add value.
